Terms of Trade (B2B)

Effective from 05.04.2022

Welcome to Robert Emile Atelier. We are a London-Marrakech based interior design and product studio working globally across bespoke handmade goods, artisanal tiles, rugs, furniture, and stone. These Terms of Trade apply to all business-to-business (B2B) transactions. By placing an order with us, you agree to the following terms:

1. Nature of Products

All Robert Emile products are ethically produced by hand using ancient artisanal techniques. This process is central to our design philosophy and supports traditional craftspeople in Morocco, Italy, and beyond.

As such:

  • Variations in colour, tone, texture, dimensions, and finish are natural and intentional.

  • No two pieces are ever exactly the same, this is a hallmark of the artisan process.

  • Reference images, colour samples, and prototypes are representative only and may differ slightly from the final delivered product.

We do not accept complaints or returns on the basis of minor variation, tonal difference, or perceived imperfection within reasonable artisan limits.

. Orders & Payments

  • Orders must be confirmed in writing or via approved digital quotation.

  • A 50% non-refundable deposit is required to begin production.

  • Once the deposit has been received and the order is confirmed by Robert Emile Atelier (including agreement on colour, size, material, and other specifications), the order is considered final.

  • Any changes, adjustments, or queries must be submitted promptly and in writing.

    If changes are requested after production has begun, they may not be possible, and if they are, they will be chargeable in full to the client.

  • The remaining 50% balance must be paid in full prior to shipment.

  • All prices are exclusive of VAT unless otherwise stated.

  • Ownership of goods remains with Robert Emile Atelier until full payment is received.

3. Delivery, Shipping & Insurance

  • All shipments are sent under one of the following international trade terms:

    • EX WORKS (EXW): The client arranges collection from our workshop. Risk passes to the buyer once the goods are made available for pickup.

    • C&F (Cost & Freight): We arrange delivery to the destination port, but insurance is not included.

  • Insurance on all shipments is optional and the sole responsibility of the client.

    If insurance is required, it must be requested in writing before final payment is made.

  • All goods are shipped from either Morocco or Italy to global destinations. Goods do not pass through the UKunless explicitly requested for delivery to a UK-based client.

  • We are happy to recommend trusted freight agents, but Robert Emile Atelier accepts no liability for:

    • Delays

    • Damage

    • Loss

    • Customs or import-related issues

  • All shipping costs, import duties, taxes, and insurance premiums are borne by the buyer, unless otherwise agreed in writing.

4. Claims, Returns & Disputes

  • The buyer is responsible for inspecting goods immediately upon delivery.

  • Any issues must be reported in writing within 48 hours of receipt.

  • After this period, all deliveries are deemed to have been accepted in full.

  • Returns are not accepted unless explicitly authorised in writing by Robert Emile Atelier.

  • If a return is approved, it must be shipped at the buyer’s cost, in original condition, and within the timeframe specified in our return instructions.

5. Bespoke & Custom Orders

  • Customised orders (including specific colours, sizes, or finishes) are non-cancellable once confirmed.

  • Any attempt to match a previous order may result in slight variation due to natural materials and hand processes.

  • We are happy to provide additional photos or swatches in advance, but final orders are binding once confirmed.

6. International B2B Trade Law

  • These Terms of Trade are governed by the principles of international commercial law, including (where applicable) the United Nations Convention on Contracts for the International Sale of Goods (CISG).

  • Business-to-business orders are strictly commercial transactions and are not governed by consumer protection laws in any jurisdiction (including, but not limited to, the UK Consumer Rights Act 2015, the US Uniform Commercial Code (UCC), or the EU Consumer Rights Directive).

  • All clients, regardless of location, acknowledge that these are non-consumer, commercial contracts, and as such, consumer-based return, refund, or dispute rights do not apply.

7. Legal Jurisdiction & Liability

  • These Terms are governed by the laws of England and Wales, unless otherwise agreed in writing.

  • Invoices issued from our UK company constitute legally binding commercial agreements.

  • Our liability is limited strictly to the value of the goods supplied and does not extend to any consequential, indirect, or reputational loss.

8. Credit Card Payments

For clients paying via card, please note:

  • By confirming an order, you acknowledge that all Robert Emile Atelier products are handmade and subject to variation.

  • Chargebacks or refund disputes based on subjective colour tone or finish will be disputed by us on contractual grounds.

  • We strongly encourage reviewing swatches or samples where required before confirming large bespoke orders.

9. Intellectual Property

All designs, photography, and product concepts are the intellectual property of Robert Emile Atelier Ltd and may not be copied, reproduced, or resold without prior written consent.
